Terms and Conditions
This Customer Contract (the "Contract") is between Bright Box Cleaning LLC (the "Company") and the Client (collectively referred to as the "Parties"). The Contract is effective upon Client's acceptance of the Company's proposal or estimate.
1. Acceptance of Terms
By accepting the estimate, the Client agrees to:
- All terms and conditions within this Contract.
- Authorizing the Company to execute the specified services.
- Holding the Company harmless for any property damage not caused by the Company's negligence, including pre-existing damages noted during pre-inspections.
2. Binding Agreement
This Contract is the sole agreement between the Parties, and any modifications must be signed by both Parties.
3. Authorizations
The Client agrees to:
- Grant the Company access to the property for service, pre-service assessments, and follow-ups.
- Provide a functional water spigot unless prior arrangements are made.
- Acknowledge additional fees if water supply needs supplementation.
4. Payment Terms
- Payment is due upon completion of work unless otherwise agreed.
- Late payments are subject to a 7% fee if over 10 days past due.
- Payments exceeding 30 days past due may result in civil action and discontinuation of services.
5. Risks and Liability Releases
- The Company operates with expert technicians and takes precautions to avoid damage but is not liable for damages resulting from poor maintenance or low-grade materials.
- Pre-existing damages will be documented before service.
- The Company is not responsible for plant damage caused by cleaning or for pre-existing issues.
6. House Wash Acknowledgment
- Client must provide water access or make prior arrangements.
- Pre-existing oxidation or flaws may become more visible after cleaning and are not the Company's responsibility.
- Basic window cleaning is included but may leave water spots unless advanced window cleaning is requested.
7. Roof Treatment Acknowledgment
- The Company uses solutions to eliminate algae, moss, and lichen but does not forcefully remove growth to avoid damage.
- Roof granular loss may become more noticeable after cleaning.
8. Touch-Ups on Roofs
- Touch-ups are included if necessary, but natural elements may take time to remove residual debris or discoloration.
9. Client’s Obligations on the Service Date
- Secure doors and windows.
- Remove pets, pet droppings, and sensitive materials from the service area.
- Provide water access and avoid using water outlets during the service.
- Understand that the Company is not responsible for specific issues (e.g., wasp nests, weep holes, or faulty electrical outlets).
10. Content Use and Release
The Client permits the Company to use photos, videos, and reviews for advertising without compensation. Personal information like names or addresses will not be disclosed.
11. Company’s Damages Liability
- The Company is liable for damages caused by negligence.
- The Client must report damages within two days of service completion.
12. Severability
Invalid provisions of this Contract do not affect the validity of other provisions.
13. Attorneys’ Fees and Costs
The non-breaching Party can recover reasonable attorneys' fees and related costs if the other Party breaches this Contract.
14. No Waiver of Breach
Failure to enforce a provision does not waive the right to enforce it later.
15. Forum Selection
All legal actions arising from this Contract will be under the jurisdiction of courts in Davidson County, Tennessee.
Agreement
This Contract becomes effective upon the Client's acceptance of the Company's proposal or estimate.
